J. Mitchell Smith began his legal career with Lynch, Chappell and Alsup, P.C. in Midland, Texas.  He moved to Beaumont in 1994 and joined Wells, Peyton, Greenberg and Hunt, L.L.P.  In 2001, he joined GERMER and became a principal with the firm in January 2002.  Mitch graduated with a Bachelor of Arts degree in 1988 from the University of Texas.  He received a Doctor of Jurisprudence degree from Baylor University School of Law in 1991.  Mitch practices commercial litigation, railroad litigation, and handles numerous civil appeals in the state appellate courts and on the federal level.  He has argued appeals before the United States Court of Appeals for the Fifth Circuit, the Supreme Court of Texas, and a majority of the Texas courts of appeals, and he has prepared a Petition for a Writ of Certiorari to the Supreme Court of the United States.  Mitch was named a "Texas Rising Star" in 2004 and was selected as a "Texas Super Lawyer" in 2005-2016, an annual honor that is published in Texas Monthly Magazine.  Mitch is admitted to practice in the Supreme Court of Texas, all Texas state courts, the United States District Court for the Eastern, Southern and Western Districts of Texas, as well as the United States Court of Appeals for the Fifth Circuit and the Supreme Court of the United States.  Mitch is a member of the State Bar of Texas and the Jefferson County Bar Association (Director, 2006-2008; 2014-present).  He is also a member of the Texas Association of Defense Counsel, National Association of Railroad Trial Counsel, Bar Association of the Fifth Federal Circuit, American Board of Trial Advocates, Houston Chapter of American Board of Trial Advocates, and he is a Fellow of the Texas Bar Foundation.

Mitch practices in the areas of appellate law, civil litigation, commercial litigation, transportation, maritime, personal injury defense, and railroad litigation.
